CANCELLATION POLICY
Cancellation fees are based on the total booking price and are calculated from the start date of the stay period. In the event that the guest cancels a reservation after confirming it, the cancellation fees are as follows:
Chile Policy
- If cancellation is made 91 days or more before check-in, 40% of the total booking amount will be retained.
- If cancellation is made between 45 and 90 days before check-in, 60% of the total booking amount will be retained.
- If cancellation is made between 15 and 44 days before check-in, 80% of the total booking amount will be retained.
- If cancellation is made 14 days or less before check-in, 100% of the total booking amount will be retained and there will be no refund.
Notes:
- Reservation: reserved nights + additional services for each property.
- Sundes Service Fee is non-refundable.
- The security deposit is excluded from the cancellation fee and is 100% refundable (unless deductions for damages or penalties for breach of property rules apply).
- Guests agree at the time of payment that the cancellation policy is as described above, meaning refunds will only be considered if within the timeframes stipulated by our cancellation policy.
- Reduction in the length of stay for any reason may be considered a cancellation and charges may apply. We reserve the right to reduce the cancellation fee at our discretion.
Guest Payment Policy:
The guest must pay 50% to reserve the property and the remaining 50% must be paid no later than 91 days before check-in. If the second payment is not made within this period, the reservation will be considered cancelled by the guest and the corresponding cancellation policy will apply.
If the reservation is made less than 91 days before check-in, the guest must pay 100% to reserve the property.
If the second payment is not made within this period, the reservation will be considered cancelled by the guest and the corresponding cancellation policy will apply.
Sundes acts only as an authorized collection agent for the owner. In no case will Sundes be obligated to transfer funds to the owner that have not been effectively paid and credited by the guest.
Host Payment Policy:
The owner will receive payment for their arrival 6 to 24 hours after guest check-in, as Sundes protects guests' money in case of cancellations by the owner
In no case will Sundes be obligated to advance payments or transfer amounts not effectively received.
Host Cancellation Policy
If the property owner cancels the reservation, 100% of the payment will be refunded to the guest. The owner will have 48 hours to refund any payment made through Sundes. Additionally, a negative rating will be applied to the property.
Right of Cancellation by Sundes
Cancellation for breach, conflictive conduct, or attempted modification of conditions.
Sundes reserves the right to cancel, in whole or in part, any confirmed reservation, without liability to Sundes, in the event that the Guest and/or Owner:
a) Attempts to unilaterally modify essential conditions already agreed upon and confirmed, including, but not limited to, price, payment method, dates, number of guests, usage rules, or stay conditions.
b) Conditions the execution of the reservation on the payment of additional amounts not originally agreed upon.
c) Maintains conflictive, abusive, intimidating, or bad faith conduct that, in Sundes' reasonable judgment, makes proper execution of the reservation unfeasible.
d) Fails to comply with or threatens to fail to comply with obligations assumed in the confirmed reservation or in these Terms and Conditions.
In such cases, the cancellation will be considered a consequence of the breach by the party that incurred such conduct, and will not constitute a breach by Sundes.
When applicable, Sundes will proceed to issue refunds to the Guest in accordance with the applicable cancellation policy. In the event that the breach is attributable to the Owner, Sundes may retain, offset, or demand restitution of amounts already paid to the Owner, as appropriate.
Cancellation Clause for Serious Breach of Standard
Sundes reserves the right to cancel a reservation in whole or in part, at any time prior to or during the stay, without any liability, when the existence of serious breaches in the property is verified that directly affect the habitability, hygiene, safety, or minimum dignity of the guest.
Serious breaches shall be considered, by way of example and not limitation:
Lack of minimum hygiene and cleanliness conditions (including, but not limited to, presence of evident dirt, bedding in unacceptable conditions, organic remains, or similar).
Substantial differences between what was offered and what was delivered.
Situations that generate serious discomfort, health risk, or an experience incompatible with SUNDES' quality standard.
In these cases, Sundes may arrange for the early departure of the guest, manage their relocation, or proceed with the cancellation of the reservation, refunding fully or partially the amounts paid by the guest, as appropriate to the specific case.
The owner accepts that, in situations of this type, they will not have the right to demand payments, indemnities, or compensation from Sundes, assuming full responsibility for the breach of the committed standard.
Clause for Determination of Serious Breaches, Sundes' Authority, and Cancellation Effects
The owner declares and accepts that it is their exclusive and ultimate responsibility to ensure that the property is delivered to the guest, at the time of check-in, in optimal conditions of cleanliness, order, hygiene, functionality, and safety, complying with the quality, habitability, and service standards required by Sundes.
These conditions encompass both aspects of cleanliness and hygiene, which imply that the property must be delivered in an impeccable state, including —by way of example and not limitation— bedrooms, beds, and bedding clean and sanitized, absence of hair, stains, dust, residues, or odors, bathrooms completely cleaned and disinfected, kitchen clean and operational, availability of utensils, crockery, and appliances in adequate hygienic conditions, as well as common areas, terraces, and outdoor spaces free of evident dirt. Likewise, they encompass the correct structural and operational state of the property, including the operation of the pool, heating, hot water, electricity, gas, access points, locks, and essential equipment, as well as the absence of structural or safety risks, such as walls in poor condition, detachments, serious leaks, defective installations, or any other situation that affects the physical integrity of the guest or the habitability of the property.
Notwithstanding the foregoing, Sundes may, at the owner's request or collaboratively, coordinate or provide cleaning, maintenance, or other operational services. However, such collaboration does not exempt or limit the owner's final responsibility regarding the state, functionality, and safety of the property.
The owner expressly accepts that the determination, analysis, and qualification of the existence of serious breaches, as well as the decision to maintain, cancel totally or partially a reservation, authorize or reject refunds, shall be the exclusive, autonomous, and discretionary right of Sundes, acting in accordance with its internal quality and experience standards, and shall not be subject to the sole appreciation or decision of the guest.
Consequently, only in the event that Sundes determines that serious breaches exist, the corresponding cancellation, early departure, or refund shall be attributable to the owner, who shall assume all economic, commercial, and operational effects derived from such decision, including the total or partial loss of payment corresponding to unused nights.
Conversely, if Sundes determines that no serious breaches exist, and the guest decides to cancel the reservation or withdraw from the property for personal or subjective reasons, no refund shall be issued, with the economic conditions of the reservation remaining fully in force.
The owner expressly releases Sundes from all liability, waiving any legal action, claim, or compensation derived from cancellations, refunds, loss of income, early departures, or potential reputational impacts, when such decisions have been adopted by SUNDES in accordance with its criteria and standards.
